CMed-ABPI – Meeting of the CMed-ABPI Study Group addresses the role of mediation in contract design.

Last Thursday (December 11th), the Mediation Chamber of the ABPI Dispute Resolution Center (CMed-ABPI) held a hybrid meeting of its study group focused on applying mediation skills in the contract drafting phase, to review the activities carried out and define the next steps of the initiative.
The study group was created in the middle of this year, following the event “Mediation beyond existing conflicts: facilitating negotiations and preventing conflicts” promoted by CMed-ABPI on April 28, 2025, which included the participation of lawyers specializing in contracts and conflict prevention, Fernanda Guerra and Sandra Brandão.
Under the coordination of lawyer Sandra Brandão and with the active participation of the Director of CMed-ABPI, Karin Klempp Franco FCIArb, and the Deputy Director of the Chamber, Marcos Chucralla M. Blasi, five meetings were held. Based on an examination of similar experiences, such as so-called ‘conscious contracts’, the group investigated how certain mediator skills can contribute to the design of contracts that promote conflict prevention and the maintenance of peace in relations between parties.
The study group will continue next year with its purpose of sharing knowledge and disseminating alternative dispute resolution methods, demonstrating how they can be used as early as the contract drafting phase. The group is open to all CMed-ABPI Mediators.
